The role of the judge in the hearings provided for in the General Organic Code of Processes

Abstract
The purpose of this paper was to determine the role of the judge in the hearings provided for in the General Organic Code of Processes in the Ecuadorian procedural system, its powers and limitations. The relevant aspects of the role of the judge as conciliator and decision maker were also analyzed, all from the doctrinal, normative and a comparative study with the extinct Ecuadorian Code of Civil Procedure, as well as with the Uruguayan and Colombian Procedural Code. The impartial role of the judge in the development of the hearings was analyzed, since the issuance of the General Organic Code of Processes becomes important in the Ecuadorian civil procedural regulations, since it allows to decongest the slow judicial system prevailing since the 20th century, with the to ensure due process, based on the principles of immediacy, contradiction, concentration, continuity, publicity and device, typical of the oral system
